Essence France's business is supplying refreshment equipment to professionals who wish to organize events such as trade shows. It will be referred to hereafter as the "Company".\u00ab<\/p>\n\n\n\n
The Company offers the rental, via its website available at www.essence-france.com (hereinafter referred to as the "Site"), of complete or customized packages, of quality Equipment which it owns, as well as the sale of Products.
The Company is the publisher of this website, allowing its Users to learn about the Services it offers, and to choose the Equipment that the User wishes to reserve when submitting the Order Form.
These various Services are available on the Site or at any other address that may be added to or substituted for it.
The purpose of this charter relating to the protection of personal data (hereinafter referred to as the "Charter") is to define the conditions and procedures for the collection, use and sharing of personal data (hereinafter referred to as the "Data" for the specific purposes of this Charter) that the Company is required to collect in the context of the performance of the Services it provides to users of its Site (hereinafter referred to as the "User").<\/p>\n\n\n\n
Each of the contractual terms defined within the CGUV is deemed to have the same meaning within the framework of this agreement, unless there is a contradiction with the definitions listed below which shall prevail.<\/p>\n\n\n\n
The Charter sets out the terms and conditions for the collection, use and sharing of Data that the Company collects in the course of performing the Services it provides.
Data means any information that directly or indirectly identifies a natural person within the meaning of Regulation No. 2016\/679, known as the General Data Protection Regulation, which entered into force on May 25, 2018 (hereinafter referred to as the \u00abGDPR\u00bb).
The Processing of personal data means any operation, or set of operations, performed on such data, regardless of the method used (collection, recording, organisation, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction, \u2026) within the meaning of the GDPR.<\/p>\n\n\n\n
The Company reserves the right to modify this Charter as needed, in accordance with changes in the Services offered or changes in legislation, at its sole discretion. The Company's Data Management Policy is always subject to the most recent version of this Charter. Users are encouraged to consult this Charter as often as necessary.<\/p>\n\n\n\n
In any event, any significant modification will be notified to the User by email or by any other means at least 30 (thirty) days before its effective application in order to obtain his\/her agreement.<\/p>\n\n\n\n
This information includes, in particular, User Data collected during access to the Services, such as:
The personal data of individuals representing the User, such as their legal representative, their collaborators, whether employees or not, and more specifically:
The first name;
The name;
The name of the User's company;
The User's email address;
The User's telephone number;
The User's postal address; ;
The User's bank details.<\/p>\n\n\n\n
This data is mandatory for order processing. Failure to provide this data may prevent the user from accessing the services offered.<\/p>\n\n\n\n
The data collected and processed will be kept for the entire duration of the provision of the Services, so as not to exceed the period necessary with regard to the purposes for which it is processed.<\/p>\n\n\n\n
In any event, certain categories of Data will be subject to intermediate archiving after the performance of the Services or their interruption for any reason whatsoever, if this Data is necessary for the Company to protect itself with evidence in the event of litigation. The duration of this intermediate archiving will be 5 (five) years from the date of interruption, with the exception of proof of subscription to the Services and the copy of the Contract, which will be kept for a period of 10 (ten) years from the performance of the Service, pursuant to Article L 213-1 of the Consumer Code;
In the event that the Contract signed between the Company and the User has been suspended or blocked, the Data will be kept for a period of 5 (five) years from the date of suspension, with the exception of proof of subscription to the Services and the copy of the Contract, which will be kept for a period of 10 (ten) years from the date of execution of the Service, in accordance with Article L 213-1 of the Consumer Code.<\/p>\n\n\n\n
The Company uses the Data collected from Users for the purposes of:<\/p>\n\n\n\n
The execution of the Services agreed upon between it and the User; ;
Request quotes;
Transmit the order confirmation;
Place the purchase orders;
The transmission to the User, where applicable, of information about the Services by email, SMS or any other means of communication, within the limits of the authorization given by the User; ;
Improving the quality of Services such as personalizing the offer, improving knowledge of the User through anonymized statistical analyses, where applicable;
To ensure compliance with (i) applicable legislation, (ii) normal use of the Services and (iii) this Charter;
To transmit to the User, in accordance with applicable legal provisions and with their consent where required by law, marketing, advertising and promotional messages, invitations to events and information relating to the use of the Services;
To register the User in databases;<\/p>\n\n\n\n
The Company collects and processes User Data from its Site personally through its legal representative and team, collaborators, employees or external service providers, and in any event bound by a confidentiality clause and informed of the security obligations related to the collection and processing of Data.<\/p>\n\n\n\n
As part of using the Services, some of the information collected may be transmitted:
To the teams of the Company (its legal representative and its collaborators, employees, occasional interns or external service providers);
Subject to the User's consent, to service providers involved for marketing communication purposes;
To the GDPR-certified applications that the Company needs to process the actions it performs, such as payment services in order to offer remote payment of the Order by bank card, where applicable;
To the company's IT department;
To our company's hosting and backup server; ;
When the Company has a legal obligation to do so, in order to comply with any legal request;
In the event that the Company were to transfer its business by any means whatsoever, to the potential transferee of its business assets or shares of its share capital.<\/p>\n\n\n\n
The Data is stored in France, in the Company's offices, at the disposal of the Company's staff and may be transferred for simple storage to service providers selected by the Company.
The digital storage providers have committed to informing the Company beforehand and to complying, in any event, with the provisions of the GDPR so that the minimum protection guarantees of this regulation are respected.<\/p>\n\n\n\n
The User has the right to obtain a copy of the Data concerning him\/her held by the Company. To do so, he\/she must (i) either send his\/her request by email to the following address: contact@essence-france.com, if applicable, or (ii) send his\/her request by letter to the Company's address as stipulated in the preamble to this Charter.<\/p>\n\n\n\n
The Company will endeavor to respond to the User's request within a reasonable timeframe and, in any event, within the time limits set by law.<\/p>\n\n\n\n
The User also has the option to access the Data held by the Company in order to request that it rectify, modify or delete any incorrect information.<\/p>\n\n\n\n
The User has the right to object to or limit the processing of their Data.<\/p>\n\n\n\n
The User has the right, where appropriate, to lodge a complaint with the competent supervisory authority (the CNIL) or to seek redress from the competent courts if he considers that the Company has not respected his rights.<\/p>\n\n\n\n
The User also has the right to data portability, i.e. the right to receive the Data provided to the Company in a structured, commonly used and machine-readable format and the right to transmit this Data to another data controller.<\/p>\n\n\n\n
Finally, the User (if a natural person), their legal representative or any employee or collaborator who may have to communicate with the User, have the right to define guidelines regarding the fate of this Data after their death.<\/p>\n\n\n\n
